TERMS & CONDITIONS

Terms of Use

These Terms & Conditions ("T&C") apply to all rendering services provided by Solution Render Pty Ltd ("Company") and are to be read in conjunction with the Rendering Services Agreement.

By engaging the Company, the Client agrees to these T&C.

1.  Scope & General Considerations

·  Rendering works are based on drawings and documentation provided by the builder. The Client is responsible for verifying all markups before commencement.

·  Unmarked areas are not included in the scope. Additional work required for unmarked areas will be treated as a variation and priced accordingly.

·  Silicone application on technical joints is not included, unless specified.

·  Decorative or false joints are not included. If specified will be charged at $85.00 + GST per man, per hour.

·  Coloured textures or paints allow for one colour per element. Additional colours may incur variations.

·  Free and clear access to the work area must be provided. Variations may apply if additional site access preparation is required.

2. Payment & Charges

·  A 10% deposit is required before work commences.

·  Payments must be made within 7 days of invoice issuance.

·  The Company reserves the right to suspend work if payments are not received within the agreed timeframe.

·  Any delays caused by non-payment shall affect agreed project timelines, which will need to be reviewed, and adjusted accordingly.

·  Unproductive site visits due to impediments will be charged at $85.00 + GST per man, per hour.

·  Any substrate requiring more than 10mm of render will be considered a variation and charged $85.00 per man, per hour + material + GST.

3. Site Conditions & Client Responsibilities

·  The Client must provide access, power, and water supply within 30 meters of the work area.

·  If work is obstructed due to ongoing site activities, unproductive hours will be charged at the agreed hourly rate.

·  Scaffolding and height access requirements are the responsibility of the Client unless otherwise stated.

·  All work areas must be clean and free of debris before the Company commences work.

4. Variations & Additional Work

·  Any additional work beyond the agreed Scope of Works must be requested in writing.

·  Variations will be priced at $85.00 per hour per man + material + GST.

·  Patchwork after scaffold removal will be charged at the standard hourly rate.

·  One sample may be provided at no cost. Additional samples will be charged accordingly.

5. Warranty & Limitations

·  The Company warrants that materials used will be of standard or above quality.

·  Warranty applies only if the payment terms of the contract are met.

·  The warranty does not cover:

o  Structural movements causing cracks.

o  Work applied over non-complying substrates or improperly waterproofed surfaces.

o  Client-requested applications over surfaces deemed unsuitable by the Company.

6. Weather & Site Conditions

·  Rendering and plastering work is weather-dependent. Delays due to rain, extreme heat, or humidity may affect scheduling and drying times.

·  The Company is not liable for delays caused by adverse weather and reserves the right to adjust the project timeline accordingly.

·  If the Client insists on work proceeding in unfavourable weather conditions, any defects or issues caused as a result will not be covered under warranty.

7. Surface Preparation & Pre-Existing Conditions

·  The Client must ensure that all surfaces are clean, dry, and structurally sound before rendering or plastering begins.

·  If any surface is deemed unsuitable for application, the Company reserves the right to halt work and propose necessary preparatory work (charged as a variation).

·  The Company does not take responsibility for existing cracks, defects, or moisture issues that impact the final finish.

8. Colour & Finish Disclaimer

·  Colour variations may occur due to differences in substrates, drying conditions, and batch manufacturing.

·  The Client is responsible for selecting colours before commencement. Any colour change request after work starts will be treated as a variation.

·  Natural materials like Venetian plaster or lime-based finishes may have slight variations in texture and shade, which are not considered defects.

9. Site Clean-Up & Waste Management

·  The Company will keep the site tidy but is not responsible for removal of debris or waste beyond what is generated by the work performed.

·  The Client must provide a designated waste disposal area or bins for material disposal.

·  If no waste disposal solution is provided, an additional waste removal fee may apply.

10. Expansion Joints & Movement Cracks

·  Rendering & plastering applications do not prevent natural structural movement.

·  The Company will install expansion joints where required, but minor movement cracks are not covered under warranty.

·  If structural movement occurs post-completion, any repairs required will be treated as a new service, not a warranty issue.

11. Scaffolding & Height Access

·  If scaffolding or elevated work platforms are required, the Client is responsible for hiring and ensuring compliance with safety regulations unless otherwise agreed.

·  If the site is not scaffold-ready at the agreed start date, delays may incur additional charges.

12. Liability & Indemnity

·  The Company holds public liability and workers' compensation insurance.

·  The Client is responsible for insuring their property against unrelated damages.

·  The Company is not liable for structural defects or failures unrelated to its work.

13. Dispute Resolution

·  Both parties agree to attempt good-faith resolution of disputes before legal action.

·  If disputes cannot be resolved internally, mediation will be the next step.

14. Governing Law

·  These Terms & Conditions are governed by the laws of New South Wales, Australia.

By engaging Solution Render Pty Ltd, the Client acknowledges and agrees to these Terms & Conditions.
